Legal Updates for LTC

Charles will speak on admission agreements in the nursing and assisted living context and will cover a broad array of topics including statutory and regulatory requirements under state and federal law.  He will also address “best practices” provisions that should be included in your admissions documents, including the use of arbitration clauses (and the “dos and don’ts” related to them).  Charles will also cover the contract notice provisions necessary in order to trigger recourse against resident representatives and fiduciaries under state law for failure to apply for Medicaid, for failure to pay the patient liability amount, and for participation in transfers that result in an asset transfer disqualification. Finally, Charles will provide a quick recap of notable revisions to state and federal regulations affecting facilities.

Charles’ presentation will provide the participant with a working knowledge of important contractual provisions under state and federal law as well as other best practices provisions that will aid in providing predictability and protection to residents, their families, and to facilities.

Leading a Service Based Organization

The only thing that remains certain is change, which creates tension and anxiety for many people. Whether imposed or chosen, change is a challenge that often engenders fear and concern. And yet change is what keeps us from being stagnant. Change is not optional and the ability to adapt to it and maintain quality service during change is at the core of successful organizations. Those that remain resistant to change will die on the vine.

Building a Respectful Workplace

This program is designed to educate employees on how to create a respectful and inclusive workplace, how to recognize and interrupt unconscious bias in the workplace, and how words and communications can be misinterpreted and trigger issues for employees.
The session will cover:1) fostering an open, respectful workplace with constructive communication; 2) the concepts of diversity and inclusion and the methods for interrupting unconscious biases; and 3) gaining a better understanding of how our personal assumptions about people, cultures, and differences don’t necessarily lead to the smartest HR and business decisions.
This engaging and interactive program will include hypothetical scenarios so attendees can apply principles learned during the session and move towards a more respectful, diverse and inclusive workforce.

Cybersecurity:
Keeping Your Residents Safe

In 2023, Seniors lost $3.4 Billion from Internet scams. The average victim lost $34,000 of their hard-earned money. Stories of seniors losing their savings and sense of security are far too common and often, by the time they are reported, it is too late to get those funds back.
From a request by his spouse to come speak to his residents at a senior living community about cyber fraud, Chris has been presenting on this topic to seniors as a way to educate them and help them not fall victim to internet fraud and scams. Seeing a critical need to educate senior residents who are now using technology daily, Chris will present on the current Internet, text, and phone scams seniors are falling for and then present on ways that healthcare and senior living professionals can help – from educating their resident to identifying and reacting to red flags that they may see and hear. Chris will share resources and ideas on best ways to educate the senior community on these risks and reiterate that just like physical and metal health, cyber health must be a focus of senior living providers.
