Basics of the FLSA – Navigating Regular Rate & Understanding Exemptions
This breakout session introduces participants to the core principles of the Fair Labor Standards Act (FLSA), focusing on three key areas essential for compliance: the structure and purpose of the FLSA, how to correctly determine an employee’s regular rate of pay, and an understanding of the major exemptions that affect overtime eligibility.
1. FLSA Fundamentals: Participants will gain a clear understanding of FLSA coverage, minimum wage, overtime, record keeping, and child labor.
2. Navigating the Regular Rate of Pay: Participants learn how to identify what remuneration must be included, what may be excluded, and how to compute the regular rate for different pay arrangements.
3. Understanding FLSA Exemptions: This section provides an overview of FLSA exemptions, including how exemptions should be evaluated, documented, and applied. Participants learn what constitutes a properly applied exemption and the consequences of improper classification.

Ana Maria Allaire
Ana Maria Allaire is the Community and Outreach Resource Planning Specialist for the United States Department of Labor, Wage and Hour Division in the Northern New England District Office. Ana’s career at Wage and Hour began in 2020 after transferring from the Department of Defense. She started as an investigator for three years and then was promoted to the CORPS position in the summer of 2023. Ana has received the Secretary Honor, Worker Protection Award for helping lead the Northern New England Child Labor Task Force and the Secretary’s Exceptional Achievement Honor Award for contributions to the Communities of Practice. Ana enjoys traveling and spending time with her family in Maine.
